CrafterQ Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CrafterQ platform and related services (“Service”) provided by Crafter Software Corporation, a Delaware corporation with its principal place of business at 7918 Jones Branch Drive, Floor 4, McLean, Virginia, 22102 USA (“CrafterQ,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, or clicking “I Agree”, you agree to be bound by these Terms.
If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization.
1. The Service
CrafterQ is a cloud-based, self-serve AI agent platform that enables you to deploy conversational AI experiences using content, documents, websites, and data sources that you provide or connect (“Customer Content”).
The Service uses automated and probabilistic systems to generate responses (“AI Outputs”).
CrafterQ does not provide legal, medical, financial, or other professional advice.
2. Accounts, Users & Permissions
You are responsible for:
- Maintaining accurate account information
- Safeguarding login credentials
- All activity under your account
The Service includes configurable roles and permissions. You are solely responsible for managing user access and permission settings.
You must notify us promptly of any unauthorized access or suspected security incident.
3. Subscriptions, Billing & Payment
Access to the Service is sold on a subscription basis through our website or platform checkout (“Order”).
- Subscriptions begin at purchase and auto-renew unless canceled before renewal
- Fees are billed in advance and are non-refundable except as required by law
- You authorize us (or our payment processor) to charge your payment method on file
Failure to pay may result in suspension or termination of access.
Taxes are not included in fees and are your responsibility, excluding taxes on our income.
4. License & Acceptable Use
We grant you a limited, non-exclusive, non-transferable right to access and use the Service during your subscription term for internal business purposes.
You may not:
- Reverse engineer or attempt to extract source code
- Circumvent usage limits or safeguards
- Use the Service to build or train competing products
- Perform penetration testing, vulnerability scanning, or benchmarking without prior written consent
- Use the Service in violation of applicable law
Additional restrictions are described in our Acceptable Use Policy, which is incorporated by reference.
5. Customer Content & Data Rights
You retain all rights to your Customer Content.
You grant CrafterQ a limited license to process Customer Content only to:
- Operate and support the Service
- Generate AI Outputs
- Maintain security, reliability, and performance
CrafterQ processes Customer Content in a manner designed to restrict such content to Customer’s own account. Customer Content is not made accessible to, or used on behalf of, other customers, except as expressly authorized by Customer or required to operate the Service or comply with applicable law.
CrafterQ does not use Customer Content to train public or shared foundation AI models.
You represent that you have all rights necessary to provide Customer Content and that it complies with applicable law.
6. AI Outputs & Responsibility
AI Outputs are probabilistic and may be inaccurate, incomplete, or outdated.
You acknowledge and agree that:
- AI Outputs depend on the quality, completeness, and configuration of your content and sources
- Human review and validation are required before and during use
- AI Outputs are provided for informational purposes only
As between you and CrafterQ:
- You own AI Outputs generated from your Customer Content
- CrafterQ retains all rights to the platform, models, and underlying technology
7. Data Protection & Service Data
Personal data is processed in accordance with our Privacy Policy and Data Processing Addendum (DPA), both of which are incorporated by reference.
We may collect and use Service Data—aggregated and anonymized information about system performance, usage, and reliability—to operate, improve, and secure the Service. Service Data does not identify you or your users.
8. Feedback
If you provide feedback or suggestions about the Service, you grant CrafterQ a non-exclusive, worldwide, royalty-free license to use that feedback to operate, improve, and develop the Service. Feedback is non-confidential.
9. Suspension & Termination
We may suspend access for security risks, legal violations, or non-payment.
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.
Upon termination:
- Access to the Service ends
- Data deletion occurs according to the DPA
10. Disclaimers
THE SERVICE AND AI OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTERQ DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICE OR AI OUTPUTS WILL BE ERROR-FREE, UNINTERRUPTED, OR ACCURATE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CRAFTERQ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY WILL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
12. Indemnification
You agree to indemnify and hold harmless CrafterQ from claims arising out of:
- Your use of the Service
- Your Customer Content
- Your violation of these Terms or applicable law
13. Governing Law & Jury Waiver
These Terms are governed by the laws of the Commonwealth of Virginia, USA without regard to conflict-of-law principles.
YOU AND CRAFTERQ WAIVE ANY RIGHT TO A JURY TRIAL for disputes arising under these Terms.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice via the Service or our website.
Your continued use of the Service after changes become effective constitutes acceptance.
