CrafterQ Affiliate Program Agreement

This Affiliate Program Agreement (“Agreement”) is entered into by and between Crafter Software Corporation (“CrafterQ,” “we,” “us,” or “our”) and the individual or entity applying to or participating in the CrafterQ Affiliate Program (“Affiliate,” “you,” or “your”).

By applying to or participating in the Program, you agree to be bound by this Agreement.

1. Program Overview

The CrafterQ Affiliate Program (the “Program”) allows approved Affiliates to promote CrafterQ and earn commissions for qualifying customer referrals.

Affiliates will receive access to a dashboard (currently powered by a third-party platform) to generate tracking links, monitor performance, and manage payouts.

Participation is subject to approval by CrafterQ.

2. Enrollment & Eligibility

2.1 Application Required

You must submit an application and be approved to participate in the Program.

2.2 Right to Approve or Reject

CrafterQ reserves the right to approve or reject any application at its sole discretion.

2.3 Account Information

You agree to provide accurate and complete information, including payment and tax details, and to keep such information current.

3. Referral Tracking & Attribution

3.1 Tracking Platform

CrafterQ uses a third-party platform to track referrals, clicks, and conversions. Tracking is based on unique referral links assigned to Affiliates.

3.2 Attribution

Referral attribution (including cookie duration, attribution model, and qualification criteria) shall be determined by CrafterQ and/or the tracking platform in use.

3.3 Final Determination

All tracking data and attribution determinations made by CrafterQ or its platform provider shall be final and binding.

4. Commissions & Payouts

4.1 Commission Eligibility

Affiliates may earn commissions for qualifying customer referrals in accordance with the terms, rates, and conditions communicated through the affiliate dashboard or other official CrafterQ communications.

4.2 Program Terms

Commission rates, durations, qualification criteria, and payout conditions may vary based on promotional programs, affiliate tier, or other factors, and are not guaranteed unless expressly stated by CrafterQ.

4.3 Payment Timing & Thresholds

Payout schedules, minimum thresholds, and payment methods shall be as specified within the affiliate platform or communicated by CrafterQ.

4.4 Adjustments

CrafterQ reserves the right to adjust or reverse commissions in cases of:

Refunds or chargebacks
Fraudulent or invalid activity
Violations of this Agreement

5. Affiliate Responsibilities

You agree to:

Promote CrafterQ in a lawful, ethical, and professional manner
Provide accurate and truthful information about CrafterQ
Clearly disclose your affiliate relationship where required by law (e.g., FTC guidelines)
Comply with all applicable laws and regulations

6. Self-Referral & Abuse

Affiliates are prohibited from:

Earning commissions on their own purchases
Referring accounts they own or control
Creating artificial activity to generate commissions

CrafterQ may void such commissions and terminate the Affiliate account.

7. Marketing & Promotion Restrictions

To protect the integrity of the CrafterQ brand and ensure high-quality promotion, Affiliates must comply with the following restrictions:

7.1 Paid Search & SEO Restrictions

No Bidding on Brand Terms:
You may not bid on, purchase, or target keywords that include “CrafterQ” or any variations, misspellings, or confusingly similar terms (e.g., “Crafter Q”, “CrafterQ AI”) in any paid search or advertising platform without prior written approval.
No Domain Squatting or Brand Mimicry:
You may not register, use, or control domain names, subdomains, or social media handles that include “CrafterQ” or any confusingly similar variation.
No Misleading Redirects or Cloaking:
You may not use deceptive redirects, cloaking techniques, or misleading URLs that imply an official CrafterQ website or affiliation.

7.2 Coupon, Discount & Incentive Restrictions

No Unauthorized Offers:
You may not promote coupon codes, discounts, or special offers unless they are explicitly provided or approved by CrafterQ.
No Incentivized Traffic Without Approval:
You may not offer cash, rewards, rebates, gift cards, or other incentives in exchange for sign-ups or purchases without prior written approval.
No Coupon or Deal Aggregator Sites:
Promotion via coupon, discount, or deal aggregation platforms is prohibited unless explicitly approved.

7.3 Content Accuracy & Brand Safety

No Misleading or False Claims:
You must not make false, misleading, or exaggerated statements about CrafterQ’s features, pricing, or capabilities.
No Overpromising Outcomes:
You may not imply guaranteed results or outcomes (e.g., guaranteed revenue increases, fully autonomous operations) unless explicitly supported by official CrafterQ materials.
Compliance with Laws:
You must comply with all applicable advertising and disclosure regulations, including FTC endorsement guidelines.
No Harmful or Inappropriate Content:
You may not promote CrafterQ in connection with unlawful, defamatory, obscene, discriminatory, or otherwise harmful content.

7.4 Enforcement

CrafterQ reserves the right to:

Monitor Affiliate promotional activities
Require modification or removal of non-compliant content
Withhold or reverse commissions tied to violations
Suspend or terminate Affiliate participation for non-compliance

8. Brand & Intellectual Property

8.1 License Grant

CrafterQ grants you a limited, non-exclusive, revocable license to use its trademarks, logos, and approved marketing materials solely for participation in the Program.

8.2 Restrictions

You may not:

Modify or misuse CrafterQ branding
Use trademarks in domain names or social handles without permission
Suggest endorsement beyond participation in the Program

CrafterQ may revoke this license at any time.

9. Term & Termination

9.1 Term

This Agreement begins upon acceptance into the Program and continues until terminated.

9.2 Termination Without Cause

Either party may terminate participation at any time.

9.3 Termination for Cause

CrafterQ may terminate immediately for:

Fraud or abuse
Violation of this Agreement
Harm to brand or reputation
Legal or compliance risks

9.4 Effect of Termination

Upon termination:

Affiliate links may be deactivated
Unpaid commissions may be forfeited in cases of violation
Continued participation is prohibited

10. Program Modifications

CrafterQ reserves the right to modify or discontinue any aspect of the Program at any time, including:

Commission structures
Eligibility criteria
Tracking methods
Program rules

Continued participation after such changes constitutes acceptance.

11. Relationship of the Parties

Affiliate is an independent contractor. Nothing in this Agreement creates a partnership, joint venture, agency, or employment relationship.

12. Limitation of Liability

To the maximum extent permitted by law, CrafterQ shall not be liable for any indirect, incidental, or consequential damages arising from participation in the Program.

Total liability shall not exceed the commissions paid to Affiliate in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless CrafterQ from any claims, damages, or liabilities arising from:

Your participation in the Program
Your promotional activities
Your violation of this Agreement

14. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

15. General Provisions

15.1 Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the Program.

15.2 Severability

If any provision is found unenforceable, the remaining provisions shall remain in effect.

15.3 Waiver

Failure to enforce any provision shall not constitute a waiver.

16. Acceptance

By applying to or participating in the CrafterQ Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
